Metro link train driver allegedly to blame for woman's injuries

ST. LOUIS — A passenger is suing the operators of the Metro link train, citing alleged insufficient measures were taken to prevent injuries.

Kim Peters filed a complaint on Nov. 1 in the St. Louis Circuit Court against Bi-State Development Agency, d/b/a Metro, alleging that the common carrier operator failed to ensure passengers safety.

According to the complaint, the plaintiff alleges that on May 15, 2017, she was a passenger in the defendant's Metro link train. While attempting to reach for a seat, she allegedly was caused to fall when the driver started the train before she could sit. While getting off the train, she claims the defendant's employee also closed the train door and struck her with the doors. 

Peters allegedly sustained injuries to her neck, head and back resulting in physical and mental pain, as well as medical expenses. The plaintiff holds Bi-State Development Agency responsible because the defendant's driver allegedly negligently started the train without giving reasonable time for passengers to sit and closed the door without giving reasonable time for passengers to exit the train.

The plaintiff requests a trial by jury and seeks damages of more than $25,000, plus costs of this action, and any further relief that the court may deem just and proper. She is represented by Robert H. Pedroli Jr. and Eric A. Ruttencutter of Pedroli & Gauthier in Clayton.
