ST. LOUIS — A business owner is suing a general contractor, citing alleged deceptive trade practices and unjust enrichment.
Thuy Nguyen filed a complaint on Nov. 8 in the St. Louis Circuit Court against Ed Mallot Jr., d//b/a Handyman Services, alleging that the general contractor violated the Missouri Merchandising Practices Act.
According to the complaint, the plaintiff alleges that she paid the defendant $8,500 in March to renovate a location she hoped would become her business. The suit claims none of the work had been done by July and Nguyen was unable to operate her business despite continuing to pay rent on the property. The plaintiff holds Mallot responsible because the defendant allegedly took the plaintiff's check without performing any work and refused to refund any money.
The plaintiff requests a trial by jury and seeks damages of more than $25,000, plus interest, attorney's fees, costs, and any further relief as the court deems just and proper. She is represented by Sean P. Dolan of Evans & Dixon LLC in St. Louis.
