ST. LOUIS — A vehicle driver who was hit by a Bobcat is suing a Missouri corporation, citing alleged negligent entrustment.
Troy Basket filed a complaint on Nov. 16 in the St. Louis 22nd Judicial Circuit Court against Laclede Gas Company alleging that the defendant failed its duty to exercise the highest degree of care before entrusting any vehicle to a motorist to avoid injuring others.
According to the complaint, the plaintiff alleges that on April 28, 2015, he was driving his Kia Rio eastbound on Clemens Avenue when the defendant's Bobcat, driven by Torriano Hellems, turned and struck his vehicle.
As a result, Basket claims he sustained physical injuries, trauma and hospital expenses.
The plaintiff holds Laclede Gas Company responsible because the defendant allegedly failed to have known before entrusting the vehicle that the driver was incompetent to operate the vehicle in the proper manner.
The plaintiff requests a trial by jury and seeks judgment in a sum in excess of $25,000 for punitive damages, costs incurred, and for such further relief as may be just and proper. He is represented by John G. Simon and John M. Simon of The Simon Law Firm, PC in St. Louis.
