ST. LOUIS — A former worker with the Local 2375 Pile Drivers Union and the Sea-Farer International Union is suing various asbestos products manufacturers, citing alleged negligence.
Melissa Eygendaal filed a complaint on Nov. 15 in the St. Louis 22nd Judicial Circuit Court against the Crown, Cork and Seal Company Inc., The DOW Chemical Company and others, alleging that they failed to exercise reasonable care and caution for the safety of others.
According to the complaint, the plaintiff alleges that during her employment from 1971 to 1996, she was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by the defendants. On Dec. 31, 2014, she allegedly was told she had developed lung cancer, an asbestos-induced disease.
The plaintiff holds Crown, Cork and Seal Company Inc., The DOW Chemical Company and others responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available, and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.
The plaintiff requests a trial by jury and seeks damages of more than $25,000, plus costs of this action and all further relief that the court may deem just and equitable. She is represented by Laci M. Whitley of Flint Law Firm LLC in Edwardsville, Illinois.
