Patient alleges he was sexually assaulted at St. Alexius

ST. LOUIS — A patient and his guardian are suing St. Alexius Hospital, citing alleged professional negligence and failure to protect.

The male patient and his guardian filed a complaint on Nov. 14 in the St. Louis 22nd Judicial Circuit Court against St. Alexius Hospital, doing business as St. Alexius Hospital; Harmeeta Singh, MD; Nancy E. Stoll, RN; and John and Jane Doe, alleging that they failed their duty to protect patients from harm and injury.

According to the complaint, the plaintiffs said that on Nov. 11, 2015 the patient, who is mentally and physically disabled, was admitted to the hospital where he was placed in a room for patients with psychological disorders. The patient claims that he was sexually assaulted by another patient and was attacked after reporting the incident. 

The plaintiffs allege the defendants failed to create a record or report of the incident; failed to properly respond, remedy, monitor and remove the assailant from the property; failed to notify the Department of Mental Health; and denied the patient appropriate protection and freedom from physical abuse and sexual abuse while in the facility.

The plaintiffs request a trial by jury and seek judgment for compensatory damages in an amount in excess of $25,000, costs incurred, pre- and post-judgment interest, and for whatever further relief the court deems just and proper.
