ST. LOUIS — A motorist who says she was injured in a car accident is suing another driver and the city that employs him, alleging negligence.
Shylia Tomlin filed a complaint on Nov. 28 in the St. Louis Circuit Court against Lowell Lake and the City of St. Louis, alleging that Lake breached his duty to operate a motor vehicle in a careful and prudent manner.
According to the complaint, the plaintiff alleges that on Nov. 20, 2012, she was operating a motor vehicle heading east on Arsenal Street immediately past its intersection with McNair Avenue when Lake, who was acting in the course and scope of his employment, carelessly turned across the path of her vehicle and caused a collision. Tomlin allegedly sustained injuries to her neck, back and head as a result of the accident.
The plaintiff holds Lake and the City of St. Louis responsible because Lake allegedly failed to sound his horn or give warning of his approach, failed to yield, and failed to slacken speed, stop or take evasive actions to avoid collision.
The plaintiff requests a trial by jury and seeks damages of more than $25,000 plus costs expended for this action. She is represented by Cecil L. Skaggs of Central West End Law Office in St. Louis.
