Barnes-Jewish Hospital sued for alleged data breech

ST. LOUIS — A patient has filed a class-action lawsuit against BJC Health System, which operates Barnes- Jewish Hospital, citing alleged negligence and breach of fiduciary duty.

Megan L. Rosemann, individually and on behalf of all others similarly situated, filed a complaint on Nov. 20 in the St. Louis Circuit Court against BJC Health System alleging that the hospital operator failed to adequately protect and secure personal health information and personally identifiable information.

According to the complaint, the plaintiff alleges that the defendant's unreasonable conduct can result in theft of identity of a number of people, abuse and exploitation. The plaintiff holds BJC Health System responsible because the defendant allegedly negligently allowed unknown individuals to wrongfully access and obtain their records without their authorization or consent.

The plaintiff requests a trial by jury and seeks an order certifying this action may be maintained as a class action, mandatory injunction directing defendant to safeguard the  class, award for all damages, interest, attorney's fees and costs, and all other relief that are legal and equitable.
