Children blame medical providers for mother's opioid overdose

ST. LOUIS — Beneficiaries of a woman who overdosed on opioids are suing her healthcare providers, citing alleged medical malpractice and wrongful death.

Naomi Lutes and Joshua Hayden filed a complaint on Nov. 28 in the St. Louis 22nd Judicial Circuit Court against Brain D. Dieterle MD, Russell Chlysta MD, Walgreens Co., Walmart and others, alleging that they breached their duties to use the degree of skill and learning ordinarily used by a careful and prudent medical care provider.

According to the complaint, the plaintiffs allege that on Nov. 29, 2014 their mother, Elizabeth Barnett, died at her home in Blue Eye after overdosing on the narcotic pain medication oxycodone while receiving medical treatment from the defendants. 

The plaintiffs holds the defendants responsible because they allegedly regularly prescribed Barnett with high doses and high quantities of oxycodone and other opioid medications without considering any alternative treatment even though alternative treatments were available.

The plaintiffs request a trial by jury; and seek judgment against defendants in an amount in excess of $25,000, costs incurred for this action, and any other relief as the court deems just and equitable. They are represented by Wilson Sikes of Napoli Shkolnik PLLC in Edwardsville.
