SBC Contracting accused of OSHA violations

ST. LOUIS — An individual is suing a general contracting company, citing alleged insufficient measures were taken to prevent injuries on a construction site.

Benard R. Engler filed a complaint on Dec. 5 in the St. Louis Circuit Court against SBC Contracting Inc., alleging that the company violated Occupational Safety and Health Administration regulations.

According to the complaint, the plaintiff alleges that on Nov. 28, 2015 he was lawfully on a St. Louis  construction site when he fell, sustaining painful injuries to his abdomen, groin, left thigh and left left. He also suffered necessary medical and hospital care treatment of approximately $42,000, and loss of earnings of approximately $14,000. 

The plaintiff holds SBC Contracting responsible because it allegedly negligently allowed metal construction objects, which were uncapped, to remain on the construction site; and failed to warn those who were lawfully on the premises of the existence of a dangerous and defective condition.

The plaintiff requests a trial by jury and seeks judgment against the defendant in excess of $25,000, together with his costs expended for this action. He is represented by Mark F. Haywood of Mark F. Haywood LLC in St. Louis.
