Maccina employee allegedly hit woman with vehicle

ST. LOUIS — An individual is suing a driver's employer alleging negligence.

Cynthia Applegate filed a complaint on Dec. 12, in the St. Louis Circuit Court against Maccina Inc. alleging that the defendant's employee failed to operate the vehicle in a careful and prudent manner.

According to the complaint, the plaintiff alleges that on Nov. 3, 2016, she was in the roadway next to her parked vehicle when the defendant's employee negligently operated its motor vehicle and struck her. She sustained serious, painful and permanent injuries to her head, neck, shoulder and other parts of her body. 

The plaintiff holds Maccina responsible because the defendant's employee allegedly failed to maintain careful and vigilant lookout, and failed to sound a warning.

The plaintiff requests a trial by jury; and seeks damages of more than $25,000, costs of this action, and any further relief that the court may deem just and proper. She is represented by Theodore H. Hoffman and Steven M. Gelfman of Hoffman & Gelfman Attorneys PC in St. Louis.
