ST. LOUIS — A consumer has filed a class-action lawsuit against Wakefield & Associates Inc., a Colorado debt collector, citing alleged misleading representation.
Leta L. Harris filed a complaint individually and on behalf of all others similarly situated on Dec. 7 in the St. Louis Circuit Court against Wakefield & Associates alleging that the debt collector violated the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that Wakefield & Associates wrongly used a special process server who was not appointed by the court to serve her summons and petition.
The plaintiff requests a trial by jury; and seeks an order certifying this action as a class action, appointing her as class representative, an order declaring that judgment entered against her and the class members are void, an award for damages in excess of $25,000, litigation costs and expenses, and such other just and proper relief.
