Man claims driver hit his stalled car on side of the road

ST. LOUIS — A motorist is suing another driver, alleging negligence.

Antione Miller filed a complaint on Dec. 19 in the St. Louis Circuit Court against Gerald Luna alleging that the motorist failed to operate a motor vehicle in a careful and prudent manner.

According to the complaint, the plaintiff alleges that on Oct. 26, 2016, he was operating a 2001 Nissan Maxima traveling north near 14th Street and pulled over on the side of the road due to mechanical issues when the defendant struck the rear of his motor vehicle. He sustained painful and permanent injuries to his back and right shoulder. 

The plaintiff holds Luna responsible because the defendant allegedly carelessly drove his vehicle too fast for the road conditions and failed to maintain careful lookout.

The plaintiff requests a trial by jury; and seeks damages of more than $25,000, plus interest, costs, and such other just and proper relief. He is represented by Aaron M. Vogel of Schultz & Myers LLC in St. Louis.
