American Family accused of refusing to pay woman injured in accident

ST. LOUIS — An insured motorist is suing American Family Mutual Insurance Company, citing alleged breach of contract.

Shannon Olms filed a complaint on Dec. 18 in the St. Louis Circuit Court against American Family alleging that the company breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on Jan. 26, 2013, she sustained serious and permanent injuries as a result of a vehicle accident negligently caused by an underinsured driver. Her injuries allegedly are compensable under her uninsured motorist coverage issued by the defendant. 

The plaintiff holds American Family responsible because the defendant allegedly refused to make payments for the plaintiff's claim for damages.

The plaintiff requests a trial by jury; and seeks actual and compensatory damages, plus interest, costs and any other relief that the court may deem just and proper. She is represented by S. Lee Patton of Lee Patton Attorney at Law in Kirkwood.
