Passenger in crash sues Progressive for breach of contract

ST. LOUIS — A passenger is suing Darrell Gordon and Progressive Insurance, citing alleged negligence and breach of insurance contract.

Lataesha Kinnie filed a complaint on Dec. 21 in the St. Louis Circuit Court against the defendants alleging that Progressive breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on Dec. 12, 2016, she was a passenger in a motor vehicle being driven by Gordon when he allegedly ran a stop sign and caused an accident. She allegedly sustained injuries and became liable for medical expenses. At the time of the accident, Gordon was uninsured and she was insured under an automobile policy issued by Progressive. She has yet to receive the full benefits due to her. 

The plaintiff holds the defendants responsible because Gordon failed to yield the right of way and Progressive allegedly failed to make payments in accordance with the terms of her uninsured driver contract.

The plaintiff requests a trial by jury; and seeks damages in a fair and reasonable amount in excess of $25,000, plus interest, and any further relief as the court may deem just and proper. She is represented by John L. Wilbers of The Wilbers Law Firm LLC in St. Louis.
