Safe Auto accused of breach of contract

ST. LOUIS — Three motorists are suing a vehicle driver and insurer, alleging negligence and breach of insurance contract.

Gladys M. Spencer, Asia Mitchell and Quiana C. Miller filed a complaint on Jan. 3 in the St. Louis 22nd Judicial Circuit Court against Mikal Perry and Safe Auto Insurance, alleging Perry caused an accident and Safe Auto refused to make payments for their damages.

According to the complaint, the plaintiffs allege that on June 9, 2016 they were in a motor vehicle traveling on Sarah Street near its intersection with Cook Avenue when suddenly the vehicle being driven by Perry collided with the rear of their vehicle. The plaintiffs allegedly  sustained personal injuries and damages that resulted in pain and suffering, and incurred medical care and treatment expenses. 

The plaintiffs holds the defendants responsible because  Perry failed to maintain careful lookout and negligently fell asleep while driving, and Safe Auto failed to uphold an uninsured driver policy.

The plaintiffs request a trial by jury; and seek judgment in favor of plaintiffs in excess of $25,000 for each of them, and all other relief as the court deems meet and just. They are represented by James M. Martin of Martin Malec & Leopold PC in St. Louis.
