ST. LOUIS — A guest is suing the City of St. Louis and The Tower Grove Park Foundation Inc., property controller, alleging negligence.

Elaine Shashack filed a complaint on Jan. 4 in the St. Louis Circuit Court against the defendants alleging that they breached their duty to maintain the sidewalk in a reasonably safe condition.

According to the complaint, the plaintiff alleges that on Oct. 29 she was walking around a pavilion at Tower Grove Park when she stepped into a sewer depression on the sidewalk, twisted her ankle and fell. She allegedly sustained injuries to her right foot, and ankle, left knee, both hands and wrist.

The plaintiff holds the defendants responsible because they allegedly failed to repair the defects along the sidewalk, failed to warn the public of the dangerous condition and failed to barricade the same to avoid an accident.

The plaintiff requests a trial by jury; and seeks damages of not less than $25,000, costs of this action, and any further relief that the court may deem just and necessary. She is represented by Michael J. Schlueter of The Schlueter Law Firm PC in St. Louis.
