Progressive accused of breach of contract

ST. LOUIS — A motor vehicle owner is suing Progressive Casualty Insurance Company, alleging breach of contract.

Kony Ealy filed a complaint on Jan. 2 in the St. Louis 22nd Judicial Circuit Court against Progressive, alleging that the licensed insurer refused to honor its own obligations under an insurance contract.

According to the complaint, the plaintiff alleges that on July 25, 2017 he was involved in a car accident in New Madrid City that rendered his vehicle in a total loss. He made a claim under the insurance policy issued by the defendant, but it was denied.

The plaintiff holds Progressive responsible because the defendant allegedly failed to pay his claim because of its belief that he had canceled the policy before the accident.

The plaintiff requests a trial by jury; and seeks damages in an amount determined to be recoverable under the policy, plus interest, costs, and such other relief as the court may deem just and proper. He is represented by Matthew J. Sauter of Sauter Sullivan LLC in St. Louis.
