Couple allege Zimmer hip implant system was defective

Medical malpractice 06

ST. LOUIS — A couple is suing Zimmer Inc., Zimmer US Inc., Zimmer Holdings Inc. and Select Orthopedics Inc.,  citing alleged design defects with a hip implant system and failure to warn.

Jean Nattier and William Nattier filed a complaint on Jan. 5 in the St. Clair County Circuit Court against the defendants alleging that they supplied an implant system that was defective in design and formulation, and was unreasonably dangerous when it left the hands of the manufacturer.

According to the complaint, the plaintiffs allege that on Nov. 18, 2013, Jean Nattier underwent a painful, expensive and physically risky surgery to remove and replace the defendants' allegedly defective Zimmer M/L Taper with Kinective Technology Hip Implant System on her right side. As a result, Jean Natiier claims she suffered mental pain, physical disability and hospital expenses, which caused her husband, William Nattier to lose the companionship, support and affection of his wife.

The plaintiffs hold the defendants responsible because they allegedly failed to provide physicians and other consumers with true and accurate information and warnings of any known risks and harmful side effects of the medical device they marketed, distributed and sold.

The plaintiffs request a trial by jury; and seek judgment for compensatory damages for an amount that is fair and reasonable for all the injuries sustained, for costs and expenses incurred, for punitive damages, and for such other relief the court deems just and proper. They are represented by D. Todd Mathews of Gori, Julian & Association, PC in Edwardsville, Illinois and Michael F. Gallant of Bernheim Dolinsky Kelley, LLC in Washington.
