ST. LOUIS — A man who was injured in an explosion is suing boiler companies, citing alleged negligence and failure to warn.
Franklin Bobbitt filed a complaint on Jan. 4 in the St. Louis Circuit Court against Kickham Boiler & Engineering Inc., Arise Incorporated, Chicago Boiler Company, et al. alleging that the defendants failed their duty to design, manufacture, distribute, assemble, sell, inspect, test and repair products in a reasonably safe and prudent manner.
According to the complaint, the plaintiff alleges that on April 3, 2017 he was injured due a violent explosion of a leaking semi-closed receiver system at 222 Russell Blvd.
As a result, Bobbit claims he suffered serious personal injuries to his left shoulder, requiring substantial medical expenses for surgery, physical therapy and other necessary medical treatment.
The plaintiff alleges the defendants failed to properly inspect the system, and associated boilers and equipment to ensure they were in safe condition for use; failed to properly test the system, and associated boilers and equipment; and failed to adequately warn of the defects, hazards and risk of harm associated with the system, and associated boilers and equipment.
The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $25,000, additional damages for aggravating circumstances, costs incurred, and for such other and further relief as the court deems just and proper.
