ST. LOUIS — A driver is suing another motorist, alleging negligence.
Todd Cole filed a complaint on Jan. 11 in the St. Louis 22nd Judicial Circuit Court against Clea Smith alleging that she to exercise the highest degree of care while operating a motor vehicle.
According to the complaint, the plaintiff alleges that on June 19, 2016, he was stopped on Park Lane at its intersection with McLaran Avenue. While attempting to turn left, the defendant allegedlyproceeded into the intersection and struck the passenger side of his vehicle. He sustained serious, painful and permanent injuries to his neck, back, shoulder and hip.
The plaintiff holds Smith responsible because the defendant allegedly failed to keep careful lookout, failed to yield the right of way and failed to take evasive action to avoid colliding with his vehicle.
The plaintiff requests a trial by jury; and seeks judgment against defendant in excess of $25,000, plus costs expended for this action, and any other relief that the court may deem just and proper. He is represented by Ely Hadowsky of Brown & Brown LLP in St. Louis.
