Motorist claims other drive ran stop sign before hitting his car

ST. LOUIS — A motorist is suing another driver, alleging negligence.

Nate Penaflor filed a complaint on Jan. 9 in the St. Louis Circuit Court against Lau'Era Smith alleging that she failed to keep her vehicle under proper control.

According to the complaint, the plaintiff alleges that on July 26, 2017 he was driving his automobile southbound on Nebraska Avenue at its intersection with Winnebago Avenue when the defendant carelessly ran a stop sign and entered the intersection before violently colliding with his vehicle. He allegedly sustained serious and permanent injuries to his head, skull, neck, back, shoulders and limbs; and was caused to suffer pain, lost wages and medical expenses. 

The plaintiff holds Smith responsible because the defendant allegedly failed to yield the right of way and failed to take evasive actions at the first appearance of danger.

The plaintiff requests a trial by jury; and seeks compensatory damages, litigation costs and expenses, and all further relief that the court may deem just and proper. He is represented by Richard B. Hein of The Law Office of Richard B. Hein in St. Louis.
