Ciox Health accused of illegal billing practices

ST. LOUIS — An individual has filed a class-action lawsuit against a medical records providers, citing alleged illegal billing practices and unjust enrichment.

Brandon Graham individually and on behalf of all others similarly situated filed a complaint on Jan. 8, in the St. Louis Circuit Court against Ciox Health LLC alleging that the medical records providers wilfully violated the U.S. Code of Federal Regulations.

According to the complaint, the plaintiff alleges that, sometime in 2017, he requested medical records from defendant. He was billed $24.85, but never received the medical records. 

The plaintiff holds Ciox Health responsible because the defendant allegedly illegally billed its clients for a basic fee even when no records are found.

The plaintiff requests a trial by jury; and seeks an order enjoining defendant from further charging fees for non-production of documents, award for actual damages in a fair and reasonable amount, plus interest, cost and any further relief that are just and proper. He is represented by Robert Schultz and Ronald J. Eisenberg of Schultz & Associates LLP in Chesterfield.
