Couple claims other motorist drove recklessly

ST. LOUIS — A couple is suing a motorist for alleged reckless driving and violating rules of the road.

Charles Tolle and Judit Katona filed a complaint on Jan. 17 in the St. Louis Circuit Court against Betty Jean Burke alleging that she failed to exercise the highest degree of care to control her automobile and drive in a careful and prudent manner.

According to the complaint, the couple allege that on Dec. 5, 2017 Charles Tolle was driving westbound on Bates Street when his vehicle as struck on the right front by Burke's vehicle. Tolle alleges Burke crossed traffic and failed to notice a stop sign, colliding with his vehicle. 

As a result, Tolle suffered bodily injuries, emotional distress and medical expenses, which left his wife, Katone, deprived of the healthy affection, society and support of her husband. 

The plaintiffs hold Burke responsible because she allegedly failed to keep a careful lookout, failed to sound a warning, swerve or take other evasive action to avoid the collision, and failed to stop and yield to the other vehicle.

The plaintiffs request a trial by jury; and seek judgment in an amount in excess of $25,000, together with their costs, prejudgment interest, punitive damages, and for such other and further relief as the court may deem just and proper.
