ST. LOUIS — A woman is suing a food company alleging she was injured by a defective garage door on its premises.
Brenda Heiman filed a complaint on Jan. 18 in the St. Louis Circuit Court against Kyle Inc., doing business as United Fruit and Produce Company, and St. Louis Produce Market Inc. alleging that the defendants failed their duty of ordinary care, and should have known of the dangerous and defective condition inside the premises.
According to the complaint, the plaintiff alleges that on May 6, 2013 she was in the United Fruit and Produce Company building, which is owned by St. Louis Produce Market, when its garage door fell and struck her in the head, causing her to sustain severe injuries. The plaintiff alleges the defective garage door created an unreasonable hazard in an area prone to pedestrian traffic.
The plaintiff holds Kyle and St. Louis Produce Market responsible because they allegedly failed to remove the defective and dangerous condition, failed to warn of the defective and dangerous condition, and failed to barricade the area of the defective and dangerous condition.
The plaintiff requests a trial by jury; and seeks judgment in an amount that is fair and reasonable in excess of $25,000, in addition to costs incurred and such other orders as the court deems just under the circumstances. She is represented by Shaun M. Falvey of Goldblatt + Singer in St. Louis.
