ST. LOUIS — A train attendant is suing National Railroad Passenger Corporation (Amtrak), an interstate common carrier, alleging insufficient measures were taken to prevent injuries.

Antonio Bass filed a complaint on Jan. 17 in the St. Louis Circuit Court against National Railroad Passenger Corporation (Amtrak) alleging that the interstate common carrier violated the Federal Employer's Liability Act.

According to the complaint, the plaintiff alleges that during the course of employment with the defendant from Aug. 2, 1998 to the present, he was injured while performing his duties due to the violent shake and excessive lateral movement of the cars. He sustained injury to his right shoulder, and was caused to suffer medical expenses, lost wages and benefits, and pain and suffering.

The plaintiff holds National Railroad Passenger Corporation (Amtrak) responsible because the defendant allegedly failed to provide safe working conditions; failed to establish, develop and implement an ergonomic program to ensure workers' safety; and failed to warn workers about the potential injury.

The plaintiff requests a trial by jury; and seeks damages on not less than $25,000, plus costs of this action and any other relief to which he is entitled. He is represented by D. Matthew Dreesen of Dreesen Law Firm LLC in Chesterfield.
