Passenger sues two motorists involved in crash on Delmar Avenue

ST. LOUIS — A passenger is suing the driver of his vehicle as well as another motorist, alleging negligence. 

Louis L. Walker filed a complaint on Jan. 11 in the St. Louis 22nd Judicial Circuit Court against Carol D. Campbell-Scales and Marietta Mitchell alleging that they failed their duty to observe due care and precaution while operating their vehicles.

According to the complaint, the plaintiff alleges that on Nov. 5, 2011 he was passenger in a vehicle being driven by Campbell-Scales northbound on North 14th Street approaching the intersection of Delmar Avenue. Their vehicle was hit by a vehicle driven by Mitchell, who allegedly made a left turn onto Delmar Avenue heading eastbound.

As a result, Walker claims he suffered bodily injuries, emotional trauma and has undergone extensive medical treatment. 

The plaintiff holds the defendants responsible because they allegedly failed to maintain proper attention while operating their vehicle, failed to keep proper lookout and failed to reduce speed to avoid collision.

The plaintiff requests a trial by jury; and seeks judgment for actual damages in an amount in excess of $25,000, plus costs sustained, and such other and further relief as the court deems just, fair and proper. He is represented by R. Tyson Mutrux of Mutrux Finney, PC in Clayton, Missouri.
