ST. LOUIS — A vehicle passenger is suing Gary Kirchner and Joe-K Used Cars LLC, employee and employer, citing alleged negligence.
Jeremy Hartigan filed a complaint on Jan. 17 in the St. Louis Circuit Court against the defendants alleging that Joe-K failed to properly train and instruct Kirchner on how to safely operate a vehicle.
According to the complaint, the plaintiff alleges that on Oct. 5, 2015, he was a passenger in a motor vehicle and was stopped in traffic on Manchester Road in St. Louis City when Kirchner negligently caused his vehicle to hit the rear of the car. At the time of the accident, Kirchner was working for Joe-K. Hartigan allges he sustained injuries to his neck, back, right hand, right arm, wrist and both knees.
The plaintiff holds Kirchner and Joe-K Used Cars responsible because Kirchner allegedly failed to be attentive while driving and failed to take evasive actions at the first appearance of danger.
The plaintiff requests a trial by jury; and seeks damages of less than $25,000, plus interest, costs and expenses, and all further relief that the court deems just and proper. He is represented by Andrea McNairy and Lara L. Gillham of Brown & Crouppen PC in St. Louis.
