ST. LOUIS — A guest is suing a local restaurant operator, alleging negligence.
Virginia Foshage filed a complaint on Jan. 25 in the St. Louis Circuit Court against Liston Enterprises Inc. alleging that the restaurant operator breached its duty to maintain its premises in a reasonably safe condition.
According to the complaint, the plaintiff alleges that on June 16, 2016 she was a guest at defendant's restaurant, Seamus McDaniels, in St. Louis when she tripped and fell near the entryway. She allegedly sustained injuries to her hip, neck and back, incurred medical expenses of approximately $80,000, and suffered loss of income.
The plaintiff holds Liston Enterprises responsible because the defendant allegedly negligently allowed a broken or missing tile to remain unrepaired, and failed to provide warnings and/or barricade the area.
The plaintiff requests a trial by jury; and seeks judgment against the defendant in excess of $25,000, plus costs of this action, and any further relief that the court may deem just and proper. She is represented by Michael S. Sudekum of Mandel & Mandel LLP in St. Louis.
