Progressive Insurance accused of breach of contract

ST. LOUIS — An insured motorist is suing Progressive Advanced Insurance Company, alleging breach of insurance contract.

Timothy Green filed a complaint on Jan. 19 in the St. Louis Circuit Court against Progressive Advanced Insurance Company alleging that the licensed insurer failed to perform its contractual obligations.

According to the complaint, the plaintiff alleges that on May 21, 2017 he was involved in a motor vehicle collision that was caused by the negligence of an uninsured driver. He sustained significant injuries to his neck, back and legs that resulted in medical expenses and lost wages. Progressive allegedly failed to cover his losses despite his uninsured motorist coverage. 

The plaintiff holds Progressive Advanced Insurance Company responsible because the defendant allegedly breached its contractual duty to fairly and reasonably negotiate his claim.

The plaintiff requests a trial by jury; and seeks damages of not more than $75,000, plus costs of this action and any further relief as the court may deem just. He is represented by John E. Tresslar of John E. Tresslar PC in St. Louis.
