Heartland Coca-Cola accused of negligent entrustment

ST. LOUIS — A motorist is suing Heartland Coca-Cola Bottling Company LLC, a beverage company, alleging negligent entrustment.

Robert Lee filed a complaint on Jan. 31 in the St. Louis 22nd Judicial Circuit Court against Heartland Coca-Cola Bottling Company alleging that the beverage company negligently entrusted its motor vehicle to a careless driver.

According to the complaint, the plaintiff alleges that on April 12, 2016 he was lawfully stopped in traffic on West Florissant Avenue when the defendant's driver carelessly operated his truck in reverse and collided with the plaintiff's vehicle. 

The plaintiff holds Heartland Coca-Cola Bottling Company responsible because the defendant's driver allegedly breached his duty to exercise the highest degree of care by failing to maintain proper lookout, and by failing to stop, slacken speed or slow down to avoid collision.

The plaintiff requests a trial by jury; and seeks damages of more than $25,000 but less than $75,000, costs of this action, and all further relief that the court may deem just and proper. He is represented by Kyle Kleefus of the Law Offices of Derald L. Gab in St. Louis.
