Couple claims A.W. Chesterton, others to blame for lung cancer

ST. LOUIS — A couple is suing A.W. Chesterton Co., Bell & Gossett Co., McKesson Corp., and other asbestos products manufacturers and users, alleging negligence.

Richard Roach and Marilyn Roach filed a complaint on Feb. 2 in the St. Louis 22nd Judicial Circuit Court against the defendants alleging that they failed to exercise reasonable care and caution for the safety of others.

According to the complaint, the plaintiffs allege that at various times during the course of Richard Roach's employment as a laborer from 1963 to 2009, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. On Jan. 15, he first became aware that he developed lung cancer, an asbestos-induced disease that allegedly was wrongfully caused. 

The plaintiffs hold the defendants responsible because they allegedly negligently included asbestos fibers in their products when non-asbestos products were available, and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiffs request a trial by jury; and seek compensatory damages of more than $25,000, plus costs, interest and all further relief as the court may deem appropriate. They are represented by Randy S. Cohn and James R. Huss of Simmons Hanly Conroy in Alton, Illinois.
