Motorist who lost arm in crash accuses National Cargo, drivers of negligence

ST. LOUIS — A motorist is suing National Cargo Inc., Willie Thomas III, Emmanuel Webb, USAA Casualty Insurance, vehicle owner, driver and insurer, alleging negligence.

William Petty, by and through his mother and next friend Debbie Petty, filed a complaint on Feb. 7 in the St. Louis Circuit Court against the defendants alleging that they breached their duties to exercise the highest degree of care for the safety of others.

According to the complaint, the plaintiff alleges that on Jan. 21 he was operating his 2011 Lincoln Continental when he crashed into a National cargo trailer driven by Thomas. He allegedly could not avoid the trailer because it, along with Webb's vehicle, were stopped in a lane of traffic. He allegedly sustained severe, permanent and disabling injuries to his head and an amputated left upper extremity, and incurred medical expenses and loss of wages. 

The plaintiff holds National Cargo Inc., Willie Thomas III, Emmanuel Webb and USAA Casualty Insurance responsible because defendants Thomas and Webb allegedly negligently stopped their vehicles in the lanes reserved for moving vehicles in violation of the Missouri Revised Statute 300.440.

The plaintiff requests a trial by jury; and seeks damages of more than $25,000 plus costs of this action. He is represented by Todd I. Muchnick of Muchnick Haber Margolis LC in St. Louis.
