Consumers sue talcum powder manufacturers for failure to warn

Law money 10

ST. LOUIS — Consumers are suing Johnson & Johnson and others, talcum manufacturers, alleging negligence and failure to warn.

Amanda Reising, Ivette Babuca, Gloria Barotta and others filed a complaint on Feb. 1 in the St. Louis Circuit Court against the defendants alleging that they continually advertised that talc was safe for human use as evidenced in its slogan "A sprinkle a day keeps odor away".

According to the complaint, the plaintiffs allege that as a result of using defendants' Johnson Baby Powder and Shower to Shower they and/or their decedents developed ovarian cancer. They allegedly have incurred substantial medical expenses, and had to endure pain and suffering.

The plaintiffs hold Johnson & Johnson and others responsible because the defendants allegedly negligently manufactured the unreasonably dangerous and defective products, and failed to provide adequate warnings regarding the danger of using it.

The plaintiffs request a trial by jury; and seek damages in a fair and reasonable amount to punish the defendants, plus costs of this action and any other relief that the court may deem appropriate. They are represented by James G. Onder, William W. Blair and Stephanie Rados of Onderlaw LLC in St. Louis and R. Allen Smith Jr. of The Smith Law Firm PLLC in Ridgeland, Mississippi.
