CBS Corporation, others accused of negligently exposing man to asbestos

ST. LOUIS — An individual is suing CBS Corporation, Delta Star Inc., H. M. Royal Inc. and others for alleged negligence.

Debra A. Duke filed a complaint on Feb. 16 in the St. Louis 22nd Judicial Circuit Court, alleging that the defendants failed to exercise reasonable care and caution for the safety of others.

According to the complaint, the plaintiff alleges that at various times during decedent Steven Duke's career as a mechanic from 1974 to 1995, he allegedly was exposed to and inhaled or ingested asbestos fibers emanating from certain products that were allegedly manufactured, sold, distributed or installed by the defendants. On or about July 17, 2017, Steven Duke allegedly first became aware that he developed mesothelioma, an asbestos-induced disease. He allegedly died on Sept. 10, 2017. The plaintiff holds the defendants responsible for allegedly including asbestos fibers in their products when adequate substitutes allegedly were available and for allegedly failing to provide adequate warnings and instructions about the dangers of working with or around products containing asbestos fibers.

The plaintiff requests a trial by jury and seeks damages of more than $75,000, plus the costs of this action and all other relief that the court may deem just and proper.
