ST. LOUIS — An insured motorist is suing John Doe and Allstate Indemnity Company for alleged negligence and breach of insurance contract.
James Bell filed a complaint on Feb. 16 in the St. Louis Circuit Court, alleging that the insurer vexatiously refused to pay reasonable sum of monies out of its insurance policy.
According to the complaint, the plaintiff alleges that he was traveling eastbound on Neosho Street near Adkins Avenue on July 22, 2016 when John Doe, an uninsured driver, struck his vehicle, which allegedly caused the plaintiff to strike another vehicle. The plaintiff claims that he sustained injuries to his head, neck, back and shoulder. At the time of the accident, the plaintiff allegedly had an active automobile insurance policy with Allstate, and he allegedly submitted an uninsured motorist claim. The plaintiff holds the defendants responsible because defendant John Doe allegedly failed to yield right of way, maintain a careful lookout and obey traffic signs.
The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that exceeds the jurisdictional limits of this court and any further relief that the court may deem just and proper. He is represented by Lorenzo Hester of the Hester Group LLC in St. Louis.
