Western Surety Company accused of breach of duty

ST. LOUIS — A property owner is suing Anne Duarte-Miller and Western Surety Company for alleged breach of duty.

Barry Calhoun filed a complaint on Feb. 15 in the St. Louis Circuit Court, alleging that the defendants breached their duties to confirm the identity of the people who had allegedly signed an insurance title claim.

According to the complaint, the plaintiff alleges that as a result of the recorded title insurance claim, he suffered a cloud on the title to his property and had to file suit in order to clear the cloud. The plaintiff holds the defendants responsible for allegedly failing to take steps to investigate and verify the identity of the people who signed the insurance title claim.

The plaintiff requests a trial by jury and seeks damages, the costs of this action and all further relief that the court deems just and proper. He is represented by Charles S. Pullium III of Millsap & Singer LLC in St. Louis.
