ST, LOUIS — Two individuals have filed a class-action lawsuit against Lucky's Market Parent Company LLC and Lucky's Market Operating Company LLC, grocery store operators, for alleged unfair and false merchandising practices and unjust enrichment.
Paul George and Nancy Albright filed a complaint on Feb. 21 in the St. Louis Circuit Court, alleging that the defendants violated the Missouri Merchandising Practices Act.
According to the complaint, the plaintiffs allege that as a result of the defendants' alleged unlawful conduct, they have been damaged for allegedly paying a premium price for products that were not natural and actually cost less. The plaintiffs hold the defendants responsible for allegedly falsely representing that their sauces were all natural when they allegedly contained xunthan gum and/or modified food starch, which are synthetic, unnatural substances.
The plaintiff requests a trial by jury and seeks an order certifying this case as a class action. They also wish to be certified as class representatives and their counsel as class counsel. They also request an award for compensatory damages, plus interest, attorney's fees, costs and all further relief the court deems just and proper. They are represented by Matthew H.
