ST. LOUIS – A personal representative of a Mississippi man's estate alleges exposure to toxic agents caused his decedent's cancer.
Rick Jeffreys, as personal representative of the estate of James Jeffreys, deceased filed a complaint on March 14 in the St. Louis 22nd Judicial Circuit Court against BNSF Railway alleging violation of the Federal Employers Liability Act.
According to the complaint, James Jeffreys worked for the defendant from 1966 to 2002 as a truck driver and track laborer in Tennessee, St. Louis and Kansas. The suit states James Jeffreys used, worked with or was occupationally exposed to polychlorinated biphenyl compounds (PCBs), asbestos fibers and other toxic agents during part of his employment with the defendant. The plaintiff alleges this exposure caused the decedent to develop bladder cancer.
The plaintiff holds BNSF Railway responsible because the defendant allegedly failed and refused to warn decedent of the dangers of these toxic substances and failed to furnish decedent with proper protective equipment.
The plaintiff requests a trial by jury and seeks compensatory damages. He is represented by Wilson D. Sikes of Napoli Shkolnik PLLC in Edwardsville.
