Security company sales representative alleges she was assaulted, falsely imprisoned at Giovanni's Restaurant

ST. LOUIS – A security company sales representative alleges she was assaulted by an employee of a restaurant while making a business call.

Jane Doe filed a complaint on March 14 in the St. Louis Circuit Court against Giovanni Gabriele and Giovanni's Restaurant Inc. alleging assault and battery, false imprisonment and direct liability.

According to the complaint, the plaintiff was employed as a sales representative by ADT LLC and was the representative for the defendant restaurant's account. The suit states on July 6, 2016, she was at defendants' restaurant to check the security system and discuss the contract with Gabriele. 

The plaintiff alleges while at the restaurant, it was closed and she and Gabriele were the only people there. She alleges Gabriele locked the door once she arrived, forcibly kissed her and touched her inappropriately. She alleges she escaped from the restaurant and contacted police. The suit states Gabriele was later indicted Jan. 31, 2017, on one felony account of first degree attempted sodomy, one felony count first degree sexual abuse and one count third degree assault.

The plaintiff holds Gabriele and Giovanni's Restaurant Inc. responsible because as a result of the defendants' alleged conduct, she claims she suffered humiliation, mental anguish, trauma and emotional distress.

The plaintiff requests a trial by jury and seeks judgment against the defendants of more than $25,000, with interest, costs of court and all other relief that is just and proper. She is represented by Jerome J. Dobson and Amanda D. Anthony of Dobson, Goldberg, Berns & Rich LLP in St. Louis.
