Surviving husband seeks approval of wrongful death settlement with Nationwide Affinity Insurance, driver

ST. LOUIS – The surviving husband of a woman who died from injuries sustained in a collision is seeking the approval of a proposed settlement.

James Vassallo filed a petition for approval of a wrongful death settlement on March 13 in the St. Louis Circuit Court against Latonia Waites and Nationwide Affinity Insurance Co.

According to the petition, on Aug. 24, 2015, plaintiff's wife, Peggy K. Vassallo, was struck by a motor vehicle driven by defendant Waites, an underinsured driver. The petition states that the defendants have denied and continue to deny liability, but the parties have agreed to waive a jury and submit the proposed settlement.

The plaintiff requests the approval of the proposed wrongful death settlement agreement. He are represented by Alan S. Mandel of Mandel & Mandel LLP in St. Louis.
