SSM Cardinal Glennon Children's Hospital, physician named in wrongful death suit

ST. LOUIS – A mother has filed suit against several health care providers after her 20-year-old son died of bacterial meningitis.

Karmen McClendon, individually and as the surviving mother of Makael R. McClendon, deceased filed a complaint on March 21 in the St. Louis 22nd Judicial Circuit Court against the Colleen Fitzpatrick MD, SSM Cardinal Glennon Children's Hospital, St. Louis University, et al. alleging wrongful death and medical malpractice.

According to the complaint, the plaintiff alleges that on Oct. 9, 2016, Makael McClendon presented to Cardinal Glennon with a five-day history of abdominal pain. The suit states a chest X-ray revealed evidence of left lower lobe pneumonia and the decedent was prescribed medication and sent home.

The suit states the decedent continued to experience complications and was treated by Cardinal Glennon and physicians various times. The plaintiff alleges on Jan. 7, 2017, the decedent was taken to St. Louis University Hospital and declared dead the same day. The suit states a medical examiner determined his cause of death to be bacterial meningitis due to left lower lobe pneumonia.

The plaintiff holds Fitzpatrick, SSM Cardinal Glennon Children's Hospital, St. Louis University, et al. responsible because the defendants allegedly failed to properly evaluate decedent's medical condition.

The plaintiff requests a trial by jury and seeks damages of no less than $25,000 plus costs and all further relief that the court may deem just. She is represented by John G. Simon, Timothy M. Cronin and John M. Simon of The Simon Law Firm PC in St. Louis.
