ST. LOUIS – A St. Louis resident has filed suit against a corporation specializing in the production of power-based products and its sister company over allegations they failed to warn consumers of the risks of developing ovarian cancer.
Kristan Nickels filed a complaint on March 19 in the St. Louis 22nd Judicial Circuit Court against PTI Union LLC and PTI Royston LLC, both doing business as Pharma Tech Industries, citing strict liability for failure to warn, negligence and other counts.
According to the complaint, the plaintiff alleges that between 1973 and 2016, she purchased and used talcum powder and in September 2017, was diagnosed with ovarian cancer. She alleges the defendants were negligent in connection with the research, processing, bottling, labeling and/or distributing Johnson & Johnson Baby Powder and Shower to Shower products.
The plaintiff holds PTI Union LLC and PTI Royston LLC responsible because the defendants allegedly failed to provide adequate warning or instruction to consumers regarding the risk of ovarian cancer when talc products are applied to the female perineal area.
The plaintiff requests a trial by jury and seeks punitive damages in an amount sufficient to punish defendants and deter them and others from engaging in similar conduct, litigation costs and any further relief as the court may deem just and appropriate.
