ST. LOUIS – A woman alleges her late husband's exposure to benzene during his career contributed to his death.
Carol Wahby, individually and as the surviving heir of George Wahby, filed a complaint on March 21 in the St. Louis 22nd Judicial Circuit Court against 3M Co., Champion Brands LLC, United States Steel Corp., et al. alleging wrongful death and other counts.
According to the complaint, the plaintiff alleges that during decedent George Wahby's career at various locations in Missouri, he was exposed to and inhaled or absorbed benzene and/or benzene fumes emanating from defendants' products. The suit states he developed myelodysplastic syndrome, a benzene-related disease, allegedly as a result and died on March 23, 2017.
The plaintiff holds 3M Co., Champion Brands LLC, United States Steel Corp., and others responsible because the defendants allegedly used benzene in their products when adequate alternatives were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing benzene compounds.
The plaintiff requests a trial by jury and seeks compensatory, punitive and exemplary damages of no less than $25,000, plus costs of the action and all further relief as the court deems just and equitable. She is represented by Richard L. Saville Jr. of Saville Law Firm LLC in St. Louis.
