ST. LOUIS – A man alleges he developed mesothelioma as a result of asbestos exposure during his career.
Jerald Leech filed a complaint on March 23 in the St. Louis 22nd Judicial Circuit Court against Ace Hardware Corp., American Biltrite Inc., Belden Wire & Cable Corp., et al. alleging negligence and other counts.
According to the complaint, the plaintiff was diagnosed with mesothelioma in February, an asbestos-induced disease, allegedly due to his exposure to asbestos fibers emanating from certain products manufactured, sold, distributed or installed by the defendants during his career.
The plaintiff holds Ace Hardware Corp., American Biltrite Inc., Belden Wire & Cable Corp., et al. responsible because the defendants allegedly intentionally included asbestos fibers in their products when they knew that it would have toxic, poisonous and highly deleterious effect upon human health and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.
The plaintiff requests a trial by jury and seeks actual and compensatory damages of no less than $25,000 and any further relief as the court deems just and equitable. He is represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
