Insured passenger seeks underinsured motorist benefits from State Farm

ST. LOUIS – A woman alleges her damages exceeded the policy limits of a driver for injuries she sustained as a passenger in a collision.

Anna Fitzgerald filed a complaint on March 30 in the St. Louis Circuit Court against State Farm Mutual Automobile Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on March 12, 2017, she was injured in a vehicle collision due to the negligence and carelessness of an underinsured motorist. As a result, she alleges she suffered permanent injuries and damages in excess of the at-fault driver's policy limits. She is now claiming underinsured motorist benefits under the insurance policy issued by defendant, the suit states.

The plaintiff seeks damages between $25,000 and $75,000 and all further relief as the court deems just and proper. She is represented by Thomas T. Schwartz of Holloran Schwartz & Gaertner LLP in St. Louis.
