Driver alleges she is entitled to underinsured motorist coverage from American Family Mutual Insurance

ST. LOUIS – A driver is seeking coverage from her insurer over alleged damages she sustained in a St. Louis auto accident.

Kathleen Powell filed a complaint in the St. Louis Circuit Court against American Family Mutual Insurance Co. S.I. and Anthony J. Palmisano Agency LLC seeking underinsured motorist coverage.

According to the complaint, the plaintiff alleges that on Aug. 22, 2017, she was injured in an accident caused by an underinsured motorist. She alleges she sustained severe, permanent and progressive injuries resulting in medical expenses and lost wages in excess of the at-fault driver's policy limits. 

The plaintiff holds American Family Mutual Insurance Co. S.I. and Anthony J. Palmisano Agency LLC responsible because the defendants allegedly failed and refused to make payments of underinsured motorist coverage under her policy with them, asserting that the $100,000 coverage was reduced by payment of the at-fault driver's insurer and that she is entitled to nothing.

The plaintiff seeks damages in excess of $25,000, plus interest and costs of this action.
