ST. LOUIS – A consumer alleges the markers of the Ian's Natural Foods brand falsely advertises the line's products as all-natural.

Michelle Dougherty, individually and on behalf of all others similarly situated, filed a complaint on April 23 in the St. Louis Circuit Court against Elevation Brands LLC alleging violation of the Missouri Merchandising Practices Act.

According to the complaint, the plaintiff alleges that in February and March 2016, she purchased defendant's Ian's Natural Foods brand All-Natural Blueberry Pancrepes from Whole Foods for $5.99. She alleges the products are falsely advertised as all natural because they contain xantham gum, which is a synthetic substance.

The plaintiff holds Elevation Brands LLC responsible because the defendant's advertising creates the false impression that the pancrepes are only comprised of natural ingredients.

The plaintiff requests a trial by jury and seeks an order certifying this case as a class action and appointing plaintiff and her counsel as representatives, award for compensatory damages, plus interest, attorney's fees, costs and any further relief as the court may deem just and proper. She is represented by Matthew H. Armstrong of Armstrong Law Firm LLC in St. Louis and Stuart L. Cochran of Steckler Gresham Cochran PLLC in Dallas, Texas.
