Jones Realty alleges Affiliated FM Insurance denied hail damage claim without cause

ST. LOUIS – A St. Albans realty company alleges its insurer wrongfully denied its claim for property damage.

Jones Real Estate Inc., doing business as Jones Realty, filed a complaint on April 30 in the St. Louis 22nd Judicial Circuit Court against Affiliated FM Insurance Co. alleging breach of the policy and vexatious refusal to pay a claim.

According to the complaint, the plaintiff purchased an all-risk policy from the defendant in July 2017 for its property. It alleges on Oct. 9, 2017, and Nov. 5, 2017, the property was damaged by hail and it submitted a claim to the defendant, which was denied.

The plaintiff holds Affiliated FM Insurance Co. responsible because the defendant allegedly denied coverage to plaintiff's damages without reasonable cause.

The plaintiff requests a trial by jury and seeks damages of more than $25,000, plus interest, attorney's fees, costs and any further relief that the court may deem appropriate. He is represented by Jeremy P. Brummond of Lewis Rice LLC in St. Louis.
