ST. LOUIS – A commercial building owner alleges a general contractor damaged the building during a roofing job.
TL Asset LLC filed a complaint on April 27 in the St. Louis Circuit Court against Simon Construction Co. alleging that breach of warranty, negligence and negligent supervision.
According to the complaint, the plaintiff alleges that on March 8, 2017, the plaintiff contracted defendant to replace the roofing system at its commercial building at 2350 South Seventh St. in St. Louis. The plaintiff alleges that the defendant's servants and subcontractors "improperly calibrated their saws and cut past the existing roof system, down into the metal substrate of the roof, which is the structural portion of the roof."
The plaintiff alleges it was damaged in the amount of $231,534 as a result of the defendant's actions.
The plaintiff holds Simon Construction Co. responsible because the defendant allegedly breached its duty to exercise the highest degree of care, skill and learning ordinarily used by a prudent contractor under the same or similar circumstances.
The plaintiff seeks damages of $231,534, plus costs of this action and all further relief as the court may deem just. It is represented by John S. Steward and Geoffrey S. Meyerkord of Meyerkord & Meyerkord LLC in St. Louis.
