Forklift driver seeks more than $25,000 from St. Louis after equipment fell through sidewalk and into basement

ST. LOUIS – An Alpha Brewing Co. employee alleges he forklift he was using to deliver product to a vendor during the Rise Up Festival fell into a building's basement because the sidewalk collapsed.

Derrick Langeneckert filed a complaint on May 17 in the St. Louis Circuit Court against the city of St. Louis alleging premises liability.

According to the complaint, the plaintiff alleges that on Aug. 9, 2017, he was delivering products on a forklift to Alpha Brewing's vendor when the sidewalk at 1520 Washington Ave. suddenly collapsed, causing the forklift to fall onto the basement of a building. He alleges he sustained permanent and disabling injuries to his lumbar spine that caused him to suffer medical expenses, lost wages and diminished ability to enjoy life. 

The plaintiff holds the city of St. Louis responsible because the defendant allegedly failed to repair the unreasonably dangerous condition.

The plaintiff seeks damages of more than $25,000, plus costs and all further relief as the court may deem proper and just. He is represented by Andrew H. Marty and Evan M. Bettag of Chassaniol & Marty LLC in St. Peters.
